Chapter 1 General Provisions

Article 6Development and reform of people's governments at or above the county level、Technology、National religion、Public Security、Civil Affairs、Finance、Natural resources、Ecological environment、Housing and urban and rural construction、Transportation、Water Conservancy、Agriculture and rural areas、Business、Cultural Tourism、Emergency Management、Market supervision and management、Forestry、Surveying、Weather、Cultural relics and other administrative departments,Perform respective duties in accordance with the law,Work together to protect the ecological environment of Qinling Mountains。National parks within the Qinling Mountains,Nature Reserve,Scenic Area、Geopark、Forest Park、Wetland Park and other natural parks,Aquatic Germplasm Resources Reserve、Wild plant in situ protected area (site)、Important wildlife habitat and drinking water source protection zone、Botanical Garden、State-owned forest farm、Management agency of cultural relics protection units, etc.,Perform ecological and environmental protection work within the management scope in accordance with its responsibilities。

Article 8The Provincial People’s Government shall establish and improve the ecological protection compensation mechanism in accordance with relevant national regulations,Increase fiscal transfer payments,Provide ecological protection compensation to the Qinling ecological environment protection area in accordance with the law,Guide and promote ecological environment benefit areas and ecological protection areas、Establish a horizontal compensation relationship between the downstream and upstream of the basin。

Article 9Establish a diversified environmental protection investment and financing mechanism,Support the development of green finance,Attract domestic and foreign funds for Qinling ecological environment protection。Encourage donations from social organizations and individuals、Supporting Qinling ecological environment protection work。

Article 10People’s governments at or above the county level and their science and technology、Forestry、Agriculture and rural areas、Water Conservancy、Natural resources、Ecological environment、Surveying、Meteorological and other administrative departments should encourage and support scientific research and technology promotion of Qinling ecological environment protection,Promote the application of scientific and technological achievements。

Article 11Newspapers、Radio and TV、News and Publishing、Online media, etc. and natural resources、Ecological environment、Cultural Tourism、Education and other relevant departments and units should combine various environmental protection activities,Organize and carry out publicity and education work on ecological and environmental protection knowledge and laws and regulations in the Qinling Mountains,Raise citizens’ awareness of Qinling ecological environment protection。News media should strengthen public opinion supervision of Qinling ecological environment protection。

Article 12People’s governments at or above the county level commend and reward units and individuals that have made outstanding contributions to the ecological and environmental protection of the Qinling Mountains。

Chapter 2 Ecological Environmental Protection Planning

Article 15The following areas within the Qinling Mountains,Except for the urban development boundaries determined by territorial spatial planning,Should be classified as core protection areas: (1) Areas above 2,000 meters above sea level,Within 1000 meters on both sides of the main beam of the Qinling Mountains、Area within 500 meters on both sides of the main branch;(2) National Park、The core protected area of ​​the nature reserve,World Heritage;(3) First-level drinking water source protection zone;(4) The habitats of rare and endangered wild animals and other important ecological functional areas in the general control areas of nature reserves are concentrated and connected,Need for integrity、Systemically protected area。

Article 16The following areas within the Qinling Mountains,Except core protected areas、Outside the urban development boundary determined by the land spatial planning,Should be designated as key protected areas: (1) Areas between 1,500 meters and 2,000 meters above sea level;(2) National Park、General control area of ​​nature reserve,Drinking water source secondary protection zone;(3) National and provincial scenic spots、Geopark、Forest Park、Important functional areas of natural parks such as wetland parks,Botanical Garden、Water Conservancy Scenic Area;(4) Aquatic Germplasm Resources Protection Area、Wild plant in situ protected area (site)、Important habitat for wildlife,State-owned natural forest distribution area,Important Wetland,Important large and medium-sized reservoirs、Natural lake;(5) National Key Cultural Relics Protection Units、Provincial cultural relics protection unit。

Article 17Excluding core protected areas within the Qinling Mountains、Area outside key protected areas,is a general protected area。

Article 18Law、Administrative Regulations on Article 15 of these Regulations、Article 16、Core protected areas delineated in Article 17、Key protected areas、There are relevant regulations on the management of general protected areas,According to law、Execution of administrative regulations。Unless otherwise provided in these regulations,Core protected areas are not allowed to carry out ecological protection、Activities unrelated to scientific research;Key protected areas are not allowed to carry out development and construction activities that are inconsistent with their protective functions。General protected area production、Life and construction activities,The law should be strictly enforced、Provisions of regulations and these regulations。In the core protected area、Implementing energy in key protected areas、Transportation、Water Conservancy、National defense and other major infrastructure construction and strategic mineral resource exploration projects,Environmental impact assessment should be conducted in accordance with the law,Report to the Provincial People’s Government for approval。Production within Qinling、Living and construction activities should comply with the Qinling Ecological Environment Protection Plan,Take corresponding ecological and environmental protection measures in accordance with the law,Ensure that the ecological functions of Qinling Mountains are not reduced。

Article 19People’s governments at or above the county level should adhere to ecological priority、The orientation of green development,In accordance with national and provincial regulations,Eliminate high pollution、High energy consumption、High emission and backward production capacity,Encourage the development of green circular economy,Promote an ecological economic system with ecological industrialization and industrial ecology as the main body,Realizing economic structure adjustment and industrial optimization and upgrading。

Article 20Key protected areas、General protected areas implement an industry access list system。Provincial Development and Reform、Natural resources、The ecological environment administrative department shall be based on the national and provincial main functional area planning、Natural protected area system、Requirements of the Provincial Qinling Ecological Environmental Protection Master Plan,Develop key protected areas、General protected area industry access list,Submitted to the Provincial People’s Government for approval and announcement。People’s governments at all levels shall comply with the requirements of the industrial access list,Strict construction project approval,Implement ecological and environmental protection responsibilities,Strengthen supervision during and after the event。

Chapter 3 Vegetation Protection

Article 21People's governments at all levels should adopt enclosure protection、Closing mountains and prohibiting grazing、Converting farmland to forests and grassland and planting trees、Soil and water conservation、River and lake improvement、Artificial weather modification and other measures,Develop implementation plan,Strengthen the protection and natural restoration of mountains, rivers, forests, fields, lakes and grass systems,Improving the ecological environment of Qinling Mountains。

Article 22People’s governments at or above the county level shall formulate、Implement natural forests、Preferential policies and measures for protecting natural grasslands and meadows,Do a good job in protecting vegetation in Qinling Mountains。Nationally designated natural forest protection scope,No unauthorized changes。

Article 23The forestry administrative departments at or above the county level shall work with the agricultural and rural administrative departments in accordance with the requirements of ecological protection,Proposal to close mountains for afforestation、Scope of grazing ban and work plan,Report to the people's government at the same level for approval and then announce it to the public。

County-level forestry administrative departments should strengthen measures to close mountains for afforestation、Management of prohibited grazing areas,Closing mountains to cultivate forests、Set boundary stakes in areas where grazing is prohibited、Fences and Signage。

Article 24Closing mountains for afforestation、The following activities are prohibited in grazing-prohibited areas: (1) Reclamation、Quarrying、Sand Mining、Get soil;(2) Fat collection、Cutting paint、Skinning、Root digging and other deforestation activities;(3) Grazing cattle、Sheep and other herbivores;(4)Damage、Move boundary stakes without authorization、Fences and Signage;(5) Law、Other behaviors prohibited by regulations。

Article 27National Park、No logging is allowed in nature reserves,The public welfare forests designated by the national and provincial people's governments can only be harvested for tending and renewal purposes,But due to scientific research、Forestry pest control、Forest fire prevention、Except for logging required for emergency rescue and disaster relief。Commercial forest logging should strictly control the clear-cut area,Follow the national regulations on harvesting quotas。

Article 28The water administrative department at or above the county level should make reasonable plans,Take engineering measures、Measures such as plant measures and protective tillage,Soil erosion area in the control area,Reduce soil erosion。Units approved to carry out construction activities in Qinling,A water and soil conservation plan should be prepared in accordance with the law,Report to the water administrative department at or above the county level for approval before implementation。

Article 29People's governments at all levels should establish a forest and grassland fire prevention responsibility system,Delineate areas of responsibility,Implement fire prevention responsibilities,Preparing an emergency plan for forest and grassland fires,Do a good job in forest and grassland fire prevention work。Danger of forest and grassland fire,Local people’s government and emergency management at or above the county level、The forestry administrative department should immediately take corresponding firefighting measures,Report step by step in accordance with relevant regulations,And according to the national forest fire classification standards,Initiate the corresponding forest fire rescue mechanism。

Article 32Dispatching water resources in Qinling Mountains,Building hydropower stations、Reservoirs and other water projects,Should comply with the provincial Qinling ecological environment protection master plan、Special Plan dafabet loginfor water resources protection and Utilization in Qinling Mountains,Guarantee reasonable flow of rivers and lakes、Reasonable water level of groundwater,Maintain ecological balance。Construction and operation of river water storage、Water blocking engineering facilities,Ecological base flow should be guaranteed,Take measures such as building fish passing facilities,Eliminate or reduce adverse effects on aquatic wildlife。In the core protected area、No new hydropower stations are allowed in key protected areas。Hydropower stations that have been built or are under construction in the core protection zone,The people’s government at or above the county level shall organize withdrawal within a time limit in accordance with the law、Demolition,Restore Ecology;Hydropower stations that have been built or are under construction in key protected areas,The provincial water administrative department shall work together with relevant provincial administrative departments to formulate assessment and remediation standards and disposal plans,The people’s government at or above the county level shall organize rectification within a time limit or withdraw from it in accordance with the law、Demolition,Restore Ecology。

Article 33People's governments at all levels should take measures to protect vegetation,Conservation of water sources,Prevention against water disasters,Prevention and Control of Water Pollution,Protect water ecology,Strengthen river bankline management and control,Ensure sustainable utilization of water resources。River in Qinling Mountains、Within the scope of lake management,Prohibition of reclaiming land from rivers (lakes),Illegal construction of houses and other buildings (structures)、Storage materials,Setting up and setting up a tour without authorization、Fishery facilities;No stacking、Dump、Buried、Objects discharged to pollute water bodies;Other behaviors that endanger the safety of river banks and embankments and affect flood safety are prohibited。

Article 35It is prohibited to use vehicles that do not meet the anti-pollution conditions stipulated by the state,Carrying oil、Feces and other pollutants and toxic、Hazardous substances pass through the drinking water surface water source protection zone。Vehicles transporting hazardous chemicals are prohibited from passing through the drinking water surface water source protection zone;Really need to pass,Effective safety protection measures should be taken,Report to the public security organs for relevant procedures according to law,And notify the drinking water source protection area management agency。The Provincial People’s Government shall organize public security、Transportation and other administrative departments、Railway transportation enterprise,Plan a dedicated route for the transportation of hazardous chemicals or change the mode of transportation,Avoid and reduce harm to drinking surface water sources。

Article 36Strictly implement the total discharge control system of key water pollutants。City divided into districts、County (city)、District) The administrative department of ecology and environment shall control the total discharge of key water pollutants according to the total emission control indicators of key water pollutants issued by the people's government at the higher level,Draft an implementation plan for total discharge control of key water pollutants in this administrative region,And report it to the ecological environment administrative department at the next higher level for the record。Polluting units should meet emission standards and comply with total emission control requirements。

Article 37The ecological environment administrative department should strengthen the monitoring of water quality conditions in Qinling Mountains,It is found that monitoring indicators exceed water environment quality standards,Should be reported to the people’s government at or above the county level in a timely manner,People’s governments at or above the county level shall take measures to organize governance。

Chapter 5 Biodiversity Protection

Article 38The provincial ecological environment administrative department should strengthen the organization and coordination of biodiversity protection work,Huitong Provincial Forestry、Agricultural and rural administrative departments according to the types of wild animals and plants、Distribution of the Qinling Mountains Biodiversity Protection Special Plan compiled in accordance with the law,Should include the diversity of Qinling ecosystem、Species diversity、Specific measures to protect genetic diversity。

Article 39The administrative departments for the protection of wild animals and plants at or above the county level shall regularly organize or entrust relevant scientific research institutions to conduct research on Qinling wild animals and their habitats、Investigation of wild plants and their growing environment、Monitoring and Evaluation,Establishing Qinling wildlife and habitats、Protected area files。The administrative departments for wildlife protection at or above the county level shall monitor、Monitoring the impact of the environment on wildlife in Qinling Mountains,For wild animals and plants included in the list of national and provincial key protected wild animals and plants,Protective measures should be taken,Establish a breeding base if necessary、Germplasm resource bank or take ex-situ protection measures,Strengthen the protection of wild animals and plants。
